1. Introduction

Welcome to Creative Foundry Pte. Ltd. (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, products, services, software, and related materials (collectively, the “Services”). You retain ownership of any content, data, or materials you upload or submit (“User Content”) through the Services. By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to use, host, reproduce, modify, and display such content as necessary to provide and improve the Services. 6. Fees and Payment

Fees for our Services will be as described in your order, agreement, or on our website. Payments must be made in accordance with the specified terms. Late payments may result in suspension or termination of Services. All fees are exclusive of taxes unless stated otherwise.

Both parties agree to maintain the confidentiality of all non-public information obtained in connection with the use of the Services (“Confidential Information”). Confidential Information shall not include information that is or becomes publicly available, or is independently developed without reference to the other party’s Confidential Information.

8. Privacy Policy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with the Personal Data Protection Act 2012 (PDPA) of Singapore and other applicable laws.

To the fullest extent permitted by law, Creative Foundry Pte. Ltd. shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of, or inability to use, our Services. If our liability cannot be excluded by law, our aggregate liability shall not exceed the total fees paid by you for the Services in the six (6) months preceding the event giving rise to liability.

You agree to indemnify, defend, and hold harmless Creative Foundry Pte. Ltd. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising from your breach of these Terms, violation of any law, or infringement of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, if you violate these Terms or if we are required by law. Upon termination, your right to use the Services will immediately cease and any outstanding payments will become due.

13. Modifications to the Terms

We may update these Terms from time to time to reflect changes in our practices or applicable law. Any changes will be effective immediately upon posting the revised Terms, with the "Effective Date" updated above. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Singapore. Any disputes arising from or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Singapore.
